These are the official rules that govern how the Microsoft “10K in L.A. Bing cashback
Sweepstakes” promotion will operate. This promotion will be referred to as the “Sweepstakes”
throughout the rest of these rules.
In these rules, “we,” “our,” and “us” refer to Microsoft Corporation, the sponsor
of the Sweepstakes. “You” refers to an eligible Sweepstakes entrant.
1. WHAT ARE THE START AND END DATES?
This Sweepstakes entry period starts at 12:01 a.m. Central Time (CT) on November
9, 2009, and ends at 11:59 pm CT on November 25, 2009 (“Entry Period”).
Entries must be received within the Entry Period to be eligible.
2. CAN YOU ENTER?
You are eligible to enter this Sweepstakes if you are at least 18 years of age and
meet the following requirements at time of entry:
- You are a legal resident of the 50 United States or District of Columbia;
- You have or sign up for an active Windows Live ID and a Bing cashback account
prior to 11:59 pm CT on November 25, 2009. To sign up for a Bing cashback account
visit www.bing.com/cashback.
- You are NOT an employee of Microsoft Corporation or an employee of any Microsoft
subsidiary; and
- You are NOT involved in any part of the administration or execution
of this Sweepstakes; and
- You are NOT an immediate family member (defined as parent, sibling, spouse,
child regardless of where they live) and do not reside in the same household as
a Microsoft employee, an employee of a Microsoft subsidiary, or a person involved
in any part of the administration or execution of this Sweepstakes.
If you are eligible for this Sweepstakes (i.e., 18 years of age or older), but are
considered a minor in your place of residence, you should ask your parent’s or legal
guardian’s permission prior to submitting an entry in this Sweepstakes.
This Sweepstakes is void outside the United States and District of Columbia and
wherever prohibited by law.
3. HOW DO YOU ENTER?
If you are eligible for this Sweepstakes (Rule 2), go to www.bingcashbacksweeps.com and complete as directed the
entry form, including your complete first and last name and your Bing cashback email
address. There is a limit of one (1) entry per person/email address for the Entry
Period.
We are not responsible for entries that we do not receive for any reason, or for
entries that we receive, but are not decipherable for any reason.
We will automatically disqualify:
- Any incomplete or illegible entry; OR
- Any entries that we receive from you that are in excess of the entry limit described
above; OR
- Entries for which the entered email address cannot be verified to a Bing cashback
account; OR
- Entries received outside the Entry Period.
4. WHAT ARE THE PRIZES?
One (1) Grand Prize – A check for $10,000 and a travel prize that consists
of a 4 day/3 night trip for two (2) to Los Angeles, CA to attend a broadcast of
Ryan Seacrest’s radio show and a E! News television filming (subject to availability).
Prize includes round-trip coach air transportation for two from a major airport
near winner’s home to Los Angeles, CA, 3 nights hotel accommodations (one room,
double occupancy) at a Sponsor-specified hotel, a midsize rental car for 4 days
and a $1,000 gift certificate for a Hollywood Makeover. Actual retail value will
vary depending on winner’s point of departure and airfare fluctuations. Any difference
between stated approximate retail value and actual value of prize will not be awarded.
Travel subject to availability and must be completed by November 30, 2010, or prize
will be forfeited in its entirety and awarded to an alternate winner. Some restrictions
may apply. No cancellation of reservation or transfer of reservation to another
date after reservation has been made. All travel-related expenses not set forth
herein, including but not limited to meals, luggage fees, gratuities and incidental
hotel and personal expenses are the sole responsibility of the Grand Prize winner.
Sponsor is not responsible if production of the Ryan Seacrest Radio Show or the
E! News program are postponed, or cancelled after ticketing of prize for any reason,
in whole or in part. In that event, winner will receive remainder of the prize.
No compensation will be paid in lieu of the radio show and E! News portion of prize.
If potential Grand Prize is under the minimum age to rent a car, a travel stipend
of $350 will be awarded in lieu of the midsize rental car. Prize consists of
only those items specifically listed as part of the prize.
(ARV, $13,680 per Grand Prize).
One (1) First Prize: $1,000 eBay Gift Card (ARV, $1,000 per First Prize).
One (1) Second Prize: $500 eBay Gift Card (ARV, $500 per Second Prize).
The total Approximate Retail Value of all prizes is: $15,180. Limit one (1) prize
per person. In the event that a prize or portion of a prize is unavailable for any
reason, Sponsor reserves the right to award a substitute prize or portion of a prize
of equal or greater value.
If you are selected as a potential winner:
(2) You may not designate someone else as the winner. If you are unable or unwilling
to accept your prize, we will award it to an alternate potential winner;
(3) If you accept a prize, you will be responsible for all applicable taxes related
to accepting the prize, if any; and
(4) And are a minor (being under the age of majority)
in your place of residence we may award the prize to your parent/legal guardian
on your behalf.
Unless otherwise noted, all prizes are subject to their manufacturer’s warranty
and / or terms and conditions.
5. HOW ARE WINNERS SELECTED AND NOTIFIED?
At approximately 3:00 pm CT on November 30, 2009 at 10000 Highway Fifty Five, Minneapolis,
Minnesota 55441, we, or a company acting under our authorization, will select one
(1)potential Grand Prize winner, One (1) potential First Prize winner and One (1)
potential Second Prize winner in a random drawing from all eligible entries received.
If you are a potential winner, we will notify you by e-mail using the Bing cashback
e-mail address provided on your winning entry. If the prize/prize notification that
we send is returned as undeliverable, or you are otherwise unreachable for any reason,
or your eligibility cannot be verified, we may award the prize to an alternate randomly
selected winner.
If there is a dispute as to who is the potential winner, we will consider the potential
winner to be the authorized account holder of the Bing cashback e-mail address used
to enter the Sweepstakes.
If you are a potential winner, we may require you to sign an Affidavit of Eligibility
and Liability/Publicity Release. If you are a potential winner and if you are a
minor in your state of residence, we may require your parent or legal guardian to
additionally sign all required forms on your behalf. If you do not complete the
required forms as instructed and/or return the required forms within the time period
listed on the winner notification message, we may disqualify you and select an alternate
winner.
6. WHAT ARE YOUR ODDS OF WINNING?
Your odds of winning depend on the number of eligible entries we receive.
7. WHAT OTHER CONDITIONS ARE YOU ARE AGREEING TO BY ENTERING THIS SWEEPSTAKES?
By entering this Sweepstakes you agree:
(2) To the extent allowable under applicable law, to release and hold harmless Microsoft
and its respective parents, subsidiaries, affiliates, employees and agents from
any and all liability or any injury, loss, damage, right, claim or action of any
kind arising from or in connection with this Sweepstakes or any prize won;
(3) That Microsoft’s decisions will be final and binding on all matters related
to this Sweepstakes; and
(4) That by accepting a prize, Microsoft may use your name and place of residence
online and in print, or in any other media, in connection with this Sweepstakes,
without payment or compensation to you. The declaration of eligibility, use, indemnity
and liability/publicity release provided to the potential winner (pursuant to clause
5 above) will make reference to obtaining your free consent to use your name and
place of residence. In any case, the lack of such consent does not prevent the winner
from receiving the prize.
8. WHAT LAWS GOVERN THE WAY THIS SWEEPSTAKES IS EXECUTED AND ADMINISTRATED?
This Sweepstakes will be governed by the laws of the United States and the State
of Washington, and you consent to the exclusive jurisdiction and venue of the courts
of the State of Washington, United States for any disputes arising out of this Sweepstakes.
9. WHAT IF SOMETHING UNEXPECTED HAPPENS AND THE SWEEPSTAKES CAN’T RUN AS PLANNED?
If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected
event that cannot be reasonably anticipated or controlled, (also referred to as
force majeure) affects the fairness and / or integrity of this Sweepstakes, we reserve
the right to cancel, change or suspend this Sweepstakes unless to do so would be
prohibited by law and subject to any written directions from a regulatory authority.
This right is reserved whether the event is due to human or technical error or Act
of God. If a solution cannot be found to restore the integrity of the Sweepstakes,
subject to any directions from a regulatory authority, we reserve the right to select
winners from among all eligible entries received before we had to cancel, change
or suspend the Sweepstakes.
If you attempt to compromise the integrity or the legitimate operation of this Sweepstakes
by hacking or by cheating or committing fraud in ANY way, we may seek damages from
you to the fullest extent permitted by law. Further, we may ban you from participating
in any of our future Promotions, so please play fairly.

in L.A. Bing cashback Sweepstakes Winners List Request”. We will reply with the names
of confirmed winners after January 31, 2010.
